Poker and the law in the United States are quite clear, but still unclear. The poker law is clear because it states that gambling is illegal. The poker law of the US seems to be unclear because it varies and is modified with exceptions to still let the show of poker to take place around the United States. Some states in the United States permit poker, while some states abandon it. Poker law is really confusing. Despite all restricting laws, the live tournaments and million dollar prize events are still going on.
The legality of the poker in the United States depends upon:-

The Federal legislations has made a lot of amendment to already existing gambling laws in a way to not make the system too liberal and at the same time not making it too strict to the extent of abolishing the skill game altogether.
